Deposit
of made . Deposit will be fully refunded if the puppy
is not available due to illness or death of said puppy be fore balance is paid
in full to seller, or due to some cause that is the fault of the seller. NO refund will be given if the buyer chooses
not to complete the purchase of the dog for any other reason. Balance of $ must be paid in full before
when puppy is picked up or this contract will be considered void. After 2 weeks the puppy remaining the
property of the seller and any money paid shall NOT be refunded to the
buyer. Final payment must be made with
cash or a money order. Personal checks
will only be accepted with a 7-10 day clearance period before the delivery of
the puppy. Any Bounced checks will be
charged a $25.00 bounced check fee in.
1.
It
is understood that at the time of sale this puppy is not being sold as
show or breeding quality, but is a representation of its breed and structurally
and temperamentally suited as a companion.

not apply for non-registered litters)
Puppies are sold under a limited registration unless a specific request
is made by the buyer to have the full registration. Puppies are not sold or represented as being
breeding quality. That is a
determination, which is made by the buyer.
If the buyer so requests the full registration with breeding in mind,
there will be an additional fee for the full registration (fee of paid ). The buyer will have 2 weeks from the date
that they receive the puppy to determine if the puppy is indeed what they would
want to use in their breeding program.
At the end of the two weeks if the buyer has not contacted us at that
time, then we will send the puppy registration with full registration. If within the two weeks they determine that
the puppy is not suitable to breed it is there responsibility to notify us of
that fact. Then the additional fee for
the full registration will be returned no questions asked. The puppy registration will then be marked
for limited registration. Notification
must be made on or before . After the above date there will be no refund
of the additional fee.
3.
At
the time of sale, this puppy has no appearance of illness and a health record
of all shots and wormings has been provided. This guarantee does not warrant that a
veterinarian has examined this puppy. It
is recommended that the buyer have the puppy examined by a licensed
veterinarian during the first 48 hours if there is any concern on the part of
the buyer. This exam will be at the
buyer’s expense.
4.
This
puppy has a one year limited guarantee from life threatening hereditary defects
from the date of birth. Should such a
hereditary problem arise, the Buyer must return the puppy to the seller with
the signed vet report. The
seller/breeder’s vet will review this report.
If the Breeder's vet is in agreement with the report, the Breeder will
either refund 1/2 the purchase price of the puppy or give another Puppy in
replacement. The puppy will remain the
property of the breeder from then on. We
reserve the right to decide whether the puppy is returned or spayed/or neutered
before a replacement is given. If it is
returned all paper work, contracts, vaccination records and any information
from your vet must also be returned at the same time as the puppy. If the puppy is to be spayed/or neutered we
require a copy of that procedure before replacement pup is given. We are not responsible for anything else that
your vet might find wrong. That becomes
your responsibility. There are no cash
refunds or reimbursements of any kind for umbilical hernias and pinched
nostrils for they are very common among the Shih Tzu breed and are not life
threatening, there for are not bound by this contract. No replacement or reimbursement will be given
without a written statement from buyer’s veterinarian, and seller’s
veterinarian should support such statement with documentation such as diagnosis
subject to confirmation. Should reports
disagree, a neutral third veterinarian shall be called upon to settle the dispute.
5.
It
is further agreed the seller will furnish information material concerning the
proper care of this Shih Tzu, and will be available for consultation on all
aspects of caring for this Shih Tzu.
6.
It
is further agreed: neither this puppy, nor any get resulting from any breeding,
will be sold, bartered, or given to any owner, employee, or agent connected
with a Pet Shop, or to any Broker of dogs (one who acquires one or more dogs or
litters for the sole purpose of resale.) or any USDA licensed Breeder. In the event the buyer completes such a
transaction, the seller of this puppy shall have recourse through the courts
for damage to her Shih Tzu name in the amount of $1,000.00 per dog sold through
the above mentioned. Example: litter of
7 sold would be $1000.00 per pup = $7,000.00 with all legal fees involved being
the responsibility of the individual of violation of this contract.
7.
All
agreements between buyer and seller are contained in this Health Guarantee & Seller / Buyer Agreement…Any changes
or additions must be in writing and signed by both parties.
8.
This contract contains conditions established to ensure the well
being of the puppy, but also to uphold and maintain the reputation of quality
of the breed. The buyer’s agreements
will continue for the life of the dog, and the seller will have the right to
enforce the agreements.
9.
If within 10 days of purchase, your veterinarian positively
diagnosis this puppy as having a contagious diseases such as distemper and Parvo virus that was definitely incubating at the time of
purchase. The seller is to be notified
within 24 hours and 2 licensed veterinarian verifying diagnosis with lab result
must be provided within 3 business days after said diagnosis. Once we have confirmation of all the
submitted diagnosis, we will accept immediate return of the puppy and refund
the purchase price of this puppy.
10.
This
health guarantee will be terminated if this puppy was abused, does not have an
up to date health record. This guarantee
will also become null due to any injury, accidental and unintentional to this
puppy.
11.
Deposits
are non-refundable. If a deposit was
received for a certain sex, size, color and we do not have one available; you
may roll your deposit over to the next available litter.
12.
Buyer
has fully responsibility of all cost and care of this puppy after sale, and
will provide this puppy a safe, stable indoor home with proper dog food,
properly care and veterinary care as needed. The seller/breeder of this puppy
is not responsible for any type of veterinarian bill or any costs incurred by
this puppy after sale.
13.
We
will always take the puppy back and attempt to place it in a good home if you
find that you cannot keep him/her for any reason (it should be a last resort), the
seller/breeder will not refund the purchase price of the puppy.
14.
All
Legal Fees, Collection Agency Fees, or any other fees, which would incur to
enforce this contract, will be the SOLE responsibility of the BUYER. The seller/breeder reserves the right to use
any collection method available to collect unpaid fees. Seller also reserves the right to terminate
this contract at anytime prior to delivery for any reason.
By signing /
reading this document, both parties acknowledge that they have read, do understand
and agree with the terms of this contract.
Both parties have a copy of this contract. This contract has been read and understood by
the Purchaser.
The purchaser was
of sound mind the day this contract was signed.
